Lely Golf Estates is located north of RT. 41 in East Naples surrounded by Hibiscus Golf Course. It is conveniently located between downtown Naples and the outskirts of the Everglades. The development is a short drive to Marco Island and Isle of Capri.
What is a Deed restricted Community?
A Deed Restricted Community has certain covenants/ restrictions along with rules and regulations that govern the use of the property within the community, no matter if they are owner occupied or rental/investment properties. These are sometimes called governing documents. These governing documents preserve the continuity in the community and ensure that the properties are properly maintained year round. These governing documents benefit the community by keeping the community attractive & desirable to homeowners. This helps maintain or increase the value in what, for many people, is the largest and most important investment in their lives.
Florida law (720.401) requires the home seller or their agents in a deed restricted community to notify home buyers in writing prior to executing the contract for sale that there are association covenants, rules and fees. The home buyer signs this notification and acknowledges that they are aware of the governing documents. It is the responsibility of the home buyer to examine the community’s governing documents to see how they or their tenants will be affected by the existing restrictions. When the purchase is complete, the new homeowner and or their tenants agree to abide by the governing documents of the HOA.
